This cop was completely out of control, he should be fired; and he should be up on charges. 1. You don't have to sign the ticket. Signing the ticket waives your rights--and admits guilt. When they say, it does not admit guilt--they are lying to you. When you sign, YOU ARE WAIVING YOUR RIGHTS TO ADMINISTRATIVE HEARING--and you also admit to being the name (fiction) all in CAPITAL LETTERS. 2. The cop does not have a right to arrest. Under Calif. Gov. Code 202, you need to be a. Doing a breach of the peace or felony in the cops presence b. You have to voilate the public health, or of individual life or safety. 3. THE COP CANNOT TAKE OUT TASER. California Penal Code Sec. 417 states clearly, that you can only take out a taser when there is IMMINENT THREAT OF THE OFFICERS LIFE. Period. This guy had virtually every one of his rights obliterated by this cop. This cop should be gone after, he should lose his job and he should be driven out of this nation. He's nothing but a thug. PLUS--there was no crime committed. A CITIZEN CAN ONLY SUFFER A PENALTY FOR A CRIME ONLY UPON CONVICTION. This cop was judge, jury and executioner. ALSO: WE DON'T OBEY COPS. I think this cop was acting like his own personal ego was on the line. He left a man stunned by a taser and handcuffed on the side of the road a few feet from traffic . He didn't read the man his rights after the arrest despite the fact that the man asked for them more than once. He sounded pretty flippant to me when he told the other cop that the guy took a ride on the taser. While I agree that that wasn't the time or place to argue, I don't think the cop acted any better than the motorist.

All he had to do was follow simple instructions. The officer was completely justified in tasering this idiot sea lawyer. He should have arrested the wife too. The judge has to listen to their BS not the officer. That was not the time or place to argue.

Signing the ticket and he could have gone on. This is not admitting guilt, but stating you will pay the ticket or show up in court. Do not argue with cops. This one was rough, but kept it legal. You mouth off to the cop in the middle of nowhere, is always a bad idea. The cop tried to stay professional, but pushed hard to keep the situation in control and not let it turn dangerous. He should be reprimanded, but alone on the street with a man refusing to comply. This could have turned out bad for either one of them. He still handled it in the best way he could. You have a better chance with any cop when stopped by being polite, respectful, and give only simple yes or no sir answers to his questions without admitting guilt. The reason I don't do police work now, I worked for two agencies that did have cops that wouldn't hesitate to kill you and leave you on the side of the road if you gave them lip. Challenge your ticket in court with a lawyer, not try to argue it on the street with the cop. He doesn't want to arrest you and have more paperwork over a simple traffic ticket. This guy got arrested by not obeying the officer's instructions and was tasered when he headed back to the car. This is how high speed chases start and people get killed.
